Essential Long-Term Care Planning Strategies
The costs of health care keep escalating as we get older. It’s more than the need for increased doctor visits and medication and even more than the occasional hospital stay. The costs really start to explode when we require ongoing care in the simple basics of living. Long-term care planning is the strategy aimed at meeting the financial costs incurred by those needs.

Look Back and Spend Down
When a person applies for Medicaid, Texas will use a five-year “Look Back” window. What is being investigated are any income or asset transfers that took place in this period. This includes money that might have been given away or assets that were sold for less than their market value.
If the state determines that money or assets were essentially given away, the applicant will not only be denied access to benefits, but penalized in the form of a longer waiting time to become eligible for Medicaid application again.
One way the “look back” problem can be addressed is through the legal approach of “spend down”. This can involve strategic spending on allowable expenses, such as medical bills or home modifications, to bring one’s countable assets below the eligibility limits. We might also consider various strategies, such as utilizing irrevocable trusts, tax planning, and gifting, to ensure regulatory compliance while protecting your assets.
These strategies demand meticulous attention to detail and an understanding of the nuanced legal framework surrounding Medicaid eligibility and asset transfers in Texas. Our office places a priority on custom-designed solutions based on your needs, your assets, and your circumstances. We can help you put together a strategy.
